Singing in the Rain Contest Rules

  • THE RULES
  • 1. Contest Period
  • The Big Wild's Singing in the Rain contest runs from 12:01 AM Pacific Time on April 3, 2009 to 11:59 PM Pacific Time on April 30, 2009. Entries must be received by The Big Wild within that period to be eligible.
  • 2. How To Enter
  • You may enter the contest by submitting your story, photo or video about a rain-related wilderness adventure to The Big Wild as follows:
  • * Add a story, photo, or video directly on The Big Wild.org.
  • * Upload a story, photo or video to The Big Wild Facebook page. Fans can post stories, videos and photos to the 'Wall' tab. For more information, see http://www.facebook.com/help.php?page=820.
  • * Add a story, photo or video on your personal blog, and tag it 'thebigwild'. The Big Wild site manager will monitor the popular blog search engine Technorati for posts tagged 'thebigwild'. For help with tagging your posts, see http://technorati.com/help/tags.html. If you can't tag your post but you would like to enter, you can email info@thebigwild.org to inform the site manager that your post is contest-related.
  • It is solely your responsibility to ensure that your photo, story or video is properly registered as described above. The Big Wild, MEC and CPAWS will not be responsible for any lost, delayed, misdirected, illegible, or incomplete entries, or any delay or failure to transmit, process, receive or consider entries.
  • Please do not submit your entry multiple times in different categories. Also, The Big Wild staff may remove your story, photo or video from one or more of the channels identified above at their sole discretion, without any notice to you.
  • Please note that The Big Wild, MEC, and CPAWS are not associated with Facebook. Users entering the contest through Facebook must comply with Facebook's terms of use, and The Big Wild, MEC, and CPAWS will not be liable to you regarding your use of (or inability to use) Facebook.
  • 3. Eligibility — Entrants
  • You are not required to make any purchase or pay any fee to enter or win the contest.
  • You may only enter the contest if you are an individual and, at the time of entry: (1) you are a legal resident of Canada and (2) you are of the age of majority in your jurisdiction of residence, or you are at least 13 and you have consent from your parent to enter the contest. If you do not meet the Canadian residency requirement, you may still submit your entry to the channels outlined above but your entry cannot be selected as one of the winning entries, and you will not be eligible for any prizes.
  • MEC, CPAWS and The Big Wild employees and their immediate families (i.e., their spouses, siblings, children, spouses' parents, and the spouses of any of those individuals) and their household members (related or not), and anyone otherwise connected with the contest, are not eligible to enter the contest.
  • The Big Wild staff may at any time in its sole discretion disqualify any entrant who: does not meet the contest's eligibility criteria, fails to comply with these rules, attempts to enter the contest in any manner our through any means other than as described in these rules, attempts to disrupt the contest or attempts to circumvent any of these rules.
  • 4. Eligibilty — Entries
  • Your story, photo, or video must meet all of the following criteria to be eligible for the contest:
  • * It must be primarily focused on an outdoor self-propelled activity, e.g. cycling, hiking and camping, climbing, snowsports, or watersports.
  • * It must highlight an experience in the outdoors in which rain features significantly.
  • * It must not contain, depict or refer to any crude, vulgar, obscene, sexually explicit, disparaging, discriminatory, offensive, illegal or otherwise unsuitable language, activity or other content (all as determined by The Big Wild staff in its sole discretion).
  • * It must demonstrate and represent an awareness, appreciation and respect for the environment and for a safe and responsible approach to outdoor recreation.
  • * It must not contain, depict or refer to any content which disparages or refers negatively to MEC, CPAWS, The Big Wild, the contest, or any other person or entity (all as determined by The Big Wild staff in its sole discretion).
  • * It must not conflict with any of The Big Wild's core values, or otherwise be objectionable to The Big Wild (as determined by The Big Wild staff in its sole discretion).
  • * It must not contain any content that violates any law or any third party's rights (including privacy, personality and intellectual property rights).
  • * It must not promote, depict or refer to any commercial enterprises. Nor should it contain URLs or logos laid over any photos or video footage.
  • The Big Wild staff may disqualify any entry if The Big Wild staff determines (in its sole discretion) that the entry does not comply with these eligibility requirements or otherwise with these rules.
  • 5. Video Contents
  • Your video may be in colour or black and white, and may be enhanced with graphics, special effects or animation.
  • The video must be uploaded to, and received by, one of the contest web sites at www.thebigwild.org or www.facebook.com/pages/The-Big-Wild-protect-at-least-half-of-Canada/, or posted on an external site and tagged 'thebigwild' by the end of the contest period.
  • By submitting a video to The Big Wild you represent and warrant that:
  • * you are the original creator of the video;
  • * you are the sole owner of the copyright and all other rights in the video and all content in and on the video;
  • * The Big Wild will not infringe or violate any third party's intellectual property, privacy, personality or other rights when The Big Wild copies, displays, edits, modifies, transmits or otherwise uses that video in connection with the contest or any advertising; and
  • * the video meets all of the eligibility requirements set out in these rules.
  • If The Big Wild staff suspects or believes that any of the above is untrue, The Big Wild staff may disqualify your entry in its sole discretion.
  • 6. Photo Contents
  • Your photo may be in colour or black and white, and may be enhanced with graphics, special effects or animation.

  • * the photo meets all of the eligibility requirements set out in these rules.
  • If The Big Wild staff suspects or believes that any of the above is untrue, The Big Wild staff may disqualify your entry in its sole discretion.
  • 7. Story Contents
  • The story must be uploaded to, and received by, one of the contest web sites at www.thebigwild.org or www.facebook.com/pages/The-Big-Wild-protect-at-least-half-of-Canada/, or posted on an external site and tagged 'thebigwild' by the end of the contest period.
  • By submitting a story to The Big Wild you represent and warrant that:
  • * you are the original creator of the story;
  • * you are the sole owner of the copyright and all other rights in the story;
  • * The Big Wild will not infringe or violate any third party's intellectual property, privacy, personality or other rights when The Big Wild copies, displays, edits, modifies, transmits or otherwise uses that story in connection with the contest or any advertising; and
  • * the story meets all of the eligibility requirements set out in these rules.
  • If The Big Wild staff suspects or believes that any of the above is untrue, The Big Wild staff may disqualify your entry in its sole discretion.
  • 8. Subject and Participant Releases
  • If a photo, video, or story shows or tells of any individual in such a way that the individual can be recognized, you must obtain written consent from that individual to permit The Big Wild, MEC or CPAWS to copy, display, transmit and otherwise use the photo, video or story, and you must give The Big Wild staff the original copy of that consent upon The Big Wild staff's request. Entries that are submitted with inadequate documentation, as determined solely by The Big Wild staff, will not be eligible for the contest.
  • 9. Judging Process
  • The Big Wild staff will select the contest winners in its sole discretion. The judges' decisions will be based on the following criteria (weighted equally), and will not limited or restricted by category:
  • * Subject Matter – Does the entry portray authentic and unique self-propelled, wilderness-oriented recreational activities? Does the entry highlight an experience in which rain features prominently?
  • * Creativity and Uniqueness – Does the entry offer a fresh, original, creative and engaging approach to storytelling?
  • * Inspiration – Does the entry inspire viewers to get outside and participate in wilderness recreation?
  • * Responsibility – Does the video show an awareness, appreciation and respect for the environment and a safe and responsible approach to outdoor recreation?
  • The judging will be completed by May 31, 2009. Decisions of the contest judges will be final and binding.
  • 10. Winners
  • The entrant of the winning entry will be notified by email. In order for this entrant to be declared a contest winner and be eligible for a prize, the entrant must have complied with, and remain in compliance with, these rules, and must sign and deliver to The Big Wild staff a standard declaration and release form (which will include a declaration of the finalists' compliance with these rules, an acceptance of the prize as awarded, a publicity release, a liability release, and the correct answer to a skill-testing question) and any other documentation that The Big Wild, MEC or CPAWS may require.
  • The Big Wild, MEC or CPAWS may request valid proof of identity, residency, age and other relevant documentation, and The Big Wild, MEC or CPAWS may disqualify a finalist if The Big Wild staff determines (in its sole discretion) that the provided proof is not sufficient.
  • If the prize notification is returned as undeliverable, or if a selected winner does not comply with all of the above requirements within the above time frames, or does not otherwise comply with these rules, the winner will be disqualified and the contest judges will select a replacement winner.
  • The chances of winning will depend upon the number of entrants.
  • 11. Prizes
  • There is one (1) prize to be won, with a total approximate retail value of CAD $360. The prize will be awarded to the winning entry (as chosen by the contest judges). The prize consists of one (1) MEC Synergy 2 jacket (MEC Product Number: 5017-650 or 5017-649).
  • The prize must be accepted as awarded (with no substitutions), and may not be sold, transferred, or converted into cash.
  • 12. Cancellation
  • If for any reason The Big Wild cannot run the contest as planned (including as a result of bugs, tampering, unauthorized intervention, fraud, technical failures, infection by computer virus or any other cause that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this contest) The Big Wild staff may cancel, modify, extend or suspend the contest. In that event, The Big WIld staff may award a prize at random from among the eligible entries received up to the time of the impairment, or award no prizes.
  • The Big Wild staff may also disqualify any individual who tampers with or in any way corrupts the entry or voting process, or who attempts to undermine the legitimate operation of the contest by cheating, hacking, deception, or other unfair practices, or by attempting to annoy, abuse, threaten or harass any other entrants or The Big Wild representatives.
  • 13. License to The Big Wild, MEC and CPAWS
  • By entering a photo, story or video in the contest, you waive all rights you may have with respect to the entry, including all moral rights and rights of personality, publicity or privacy, and you grant to The Big Wild, MEC and CPAWS the unrestricted, royalty-free, perpetual, irrevocable, worldwide license (but not the obligation) to use, reproduce, communicate, modify and display the video (in whole or in part) for any purpose without any fee or other form of compensation, and without further notification or permission, including without limitation the following purposes:
  • * reproducing, publishing, communicating and displaying some or all of the entry as part of the contest or otherwise;
  • * identifying you by name as the owner of the entry;
  • * judging the contest; * displaying the winning entries in the contest; and
  • * for The Big Wild, MEC or CPAWS' advertising purposes, including to advertise the contest, future contests, and MEC's products and services.
  • 14. Modifications
  • You grant to The Big Wild, MEC or CPAWS the unlimited right: (i) to edit or modify your video, photo, or story in any manner, including by adding visual or aural effects or other elements; and (ii) to use, adopt and modify any or all portions of your video, photo or story in combination with other materials. When editing or modifying your entry, The Big Wild, MEC or CPAWS will use commercially reasonable efforts to maintain the original essence of the entry.
  • 15. Publicity
  • Except where otherwise prohibited by law, participation in the contest constitutes a winner's consent to The Big Wild, MEC or CPAWS' use of the winner's name, home town and province for promotional purposes without further notification, permission, payment or consideration.
  • 16. Disclaimers, Liability, and Indemnification
  • The Big Wild, MEC and CPAWS do not accept liability for any loss or damage of any stories, photos or videos entered in the contest or for any other loss or damage resulting directly or indirectly from your participation in the contest.
  • The Big Wild, MEC, and CPAWS are not responsible for: (1) incorrect or inaccurate transcription of entry information or late, lost, incomplete, misdirected entries, or entries received through impermissible or illegitimate channels; (2) technical failures of any kind, including without limitation the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any service; (4) unauthorized human intervention in any part of the entry process or the contest; (5) electronic or human error which may occur in the administration of the contest or the processing of entries; or (6) any injury or damage to persons or property, including without limitation your computer, which may be caused, directly or indirectly, in whole or in part, from your participation in the contest or from downloading any material from The Big Wild website or The Big Wild Facebook page.
  • The Big Wild, MEC & CPAWS will not be liable to you for any indirect, special, consequential, or punitive damages in connection with the contest or these rules.
  • By participating in this contest, you release and agree to indemnify and hold harmless The Big Wild, MEC, CPAWS and their employees, directors, officers, affiliates, agents, judges and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your participation in this contest or receipt or use of any prize.
  • By participating in this contest, you further agree to indemnify and hold harmless The Big Wild, MEC, CPAWS and their employees, directors, officers, members, affiliates, agents, judges and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions or losses of any kind (including actual legal fees and expenses) arising from or related to: (a) your failure to comply with any of these rules; (b) any misrepresentation you make under these rules or otherwise to The Big Wild, MEC, CPAWS; or (c) your participation in the contest.
  • 17. Personal Information
  • You consent to The Big Wild, MEC, CPAWS using and disclosing your personal information for the purposes of administering the contest; advertising the contest and any future contests and any of The Big Wild, MEC, CPAWS' products and services; and for the other purposes described in these rules. If The Big Wild, MEC, or CPAWS uses some or all of your entry for advertising purposes, The Big Wild, MEC or CPAWS will only disclose your first name in that advertising unless you consent to The Big Wild, MEC or CPAWS also disclosing your last name.
  • 18. Law
  • The Rules will be governed by and construed in accordance with the laws of the Province of British Columbia, Canada and the federal laws of Canada applicable in British Columbia.
  • 19. Disputes
  • All disputes, claims and causes of action arising out of or connected with the contest, prizes or these rules will be resolved individually, without resort to any form of class action, and exclusively by the appropriate court of the Province of British Columbia, Canada.
  • 18. Quebec Residents
  • In Canada, with respect to Quebec residents, any litigation respecting the conduct or organisation of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
  • 20. Language
  • The parties have expressly requested that this Agreement and any related document be prepared in the English language. Les parties aux présentes ont expressément demandé à ce que cette convention et les documents qui s'y rapportent soient rédigés en anglais.
