Cooking Contest Rules

  • 1. Contest Period
  • The contest runs from 12:01 AM Pacific Time on May 1, 2009 to 11:59 PM Pacific Time on May 31, 2009. Entries must be received by The Big Wild or Flickr.com within that period to be eligible.
  • 2. How To Enter
  • You may enter the contest by submitting a photo that demonstrates a cooking or food-related experience in the wildernessto The Big Wild as follows:
  • * Add a photo (link) directly on The Big Wild.org, and tag it 'bigwildcooking'.
  • * Upload a photo to a Flickr account, and tag it 'bigwildcooking'. For help using Flickr, see http://flickr.com/help.
  • It is solely your responsibility to ensure that your photo is properly registered as described above. The Big Wild, CPAWS and MEC will not be responsible for any lost, delayed, misdirected, illegible, incomplete, damaged or undeliverable entries, or any delay or failure to transmit, process, receive or consider entries.
  • Please do not submit your photo multiple times in different channels. Also, The Big Wild staff may remove your photo from one or more channels at their sole discretion, without any notice to you.
  • Please note that The Big Wild, CPAWS and MEC are not associated with Flickr. You must comply with Facebook's terms of use, and The Big Wild, CPAWS and MEC will not be liable to you regarding your use of (or inability to use) Flickr.
  • 3. Eligibility - Entrants
  • You are not required to make any purchase or pay any fee to enter or win the contest.
  • You may only enter the contest if you are an individual and, at the time of entry: (1) you are a legal resident of Canada and (2) you are of the age of majority in your jurisdiction of residence, or you are at least 13 and you have consent from your parent to enter the contest. If you do not meet the Canadian residency requirement, you may still submit your entry to the channels outlined above but your entry cannot be selected as one of the winning entries, and you will not be eligible for any prizes.
  • The Big Wild, CPAWS and MEC employees and their immediate families (i.e., their spouses, siblings, children, spouses' parents, and the spouses of any of those individuals) and their household members (related or not), and anyone otherwise connected with the contest, are not eligible to enter the contest.
  • 4. Eligibilty - Entries The Big Wild staff may at any time in its sole discretion disqualify any entrant who: does not meet the contest's eligibility criteria, fails to comply with these rules, attempts to enter the contest in any manner our through any means other than as described in these rules, attempts to disrupt the contest or attempts to circumvent any of these rules.
  • Your photo must meet all of the following criteria to be eligible for the contest:
  • * It must highlight an experience in the outdoors that is cooking or food-related.
  • * It must be primarily focused on one of MEC's core outdoor self-propelled activities: cycling, hiking and camping, climbing, snowsports, or watersports.
  • * It must not contain, depict or refer to any crude, vulgar, obscene, sexually explicit, disparaging, discriminatory, offensive, illegal or otherwise unsuitable language, activity or other content (all as determined by MEC in its sole discretion).
  • * It must demonstrate and represent an awareness, appreciation and respect for the environment and for a safe and responsible approach to outdoor recreation.
  • * It must not contain, depict or refer to any content which disparages or refers negatively to The Big Wild, CPAWS, MEC, the contest, or any other person or entity (all as determined by The Big Wild staff in its sole discretion).
  • * It must not conflict with any of The Big Wild, CPAWS and MEC's core values, or otherwise be objectionable to The Big Wild staff (as determined by The Big Wild staff in its sole discretion).
  • * It must not contain any content that violates any law or any third party's rights (including privacy, personality and intellectual property rights).
  • * It must not promote, depict or refer to any commercial enterprises. Nor should it contain URLs or logos laid over photos.
  • The Big Wild staff may disqualify any entry if they determine (in their sole discretion) that the entry does not comply with these eligibility requirements or otherwise with these rules.
  • 5. Photo Contents
  • Your photo may be in colour or black and white, and may be enhanced with graphics, special effects or animation.
  • The photo must be uploaded to, and received by, one of the contest web sites at www.thebigwild.org or www.flickr.com, and tagged 'bigwildcooking' by the end of the contest period.
  • By submitting a photo to The Big Wild you represent and warrant that:
  • * you are the original creator of the photo;
  • * you are the sole owner of the copyright and all other rights in the photo and all content in and on the photo;
  • * The Big Wild will not infringe or violate any third party's intellectual property, privacy, personality or other rights when The Big Wild copies, displays, edits, modifies, transmits or otherwise uses that photo in connection with the contest or any advertising; and
  • * the photo meets all of the eligibility requirements set out in these rules.
  • If The Big Wild staff suspects or believes that any of the above is untrue, The Big Wild staff may disqualify your entry in its sole discretion.
  • 6. Subject and Participant Releases
  • If a photo shows any individual in such a way that the individual can be recognized, you must obtain written consent from that individual to permit The Big Wild, CPAWS and MEC to copy, display, transmit and otherwise use the photo, and you must give The Big Wild, CPAWS and MEC the original copy of that consent upon The Big Wild, CPAWS or MEC's request. stories, photos, or videos that are submitted with inadequate documentation, as determined solely by The Big Wild, CPAWS and MEC, will not be eligible for the contest.
  • 7. Judging Process
  • The Big Wild staff will select the contest winners in its sole discretion. The judges' decisions will be based on the following criteria (weighted equally), and will not limited or restricted by category:
  • * Subject Matter - Does the entry portray authentic and unique self-propelled, wilderness-oriented recreational activities?
  • * Does the entry highlight an experience in which cooking or food features prominently?
  • * Creativity and Uniqueness - Does the entry offer a fresh, original, creative and engaging approach to storytelling?
  • * Inspiration - Does the entry inspire viewers to get outside and participate in wilderness recreation or to engage in activities to protect Canadian wilderness spaces?
  • * Responsibility - Does the video show an awareness, appreciation and respect for the environment and a safe and responsible approach to outdoor recreation?
  • The judging will be completed by June 30, 2009. Decisions of the contest judges will be final and binding.
  • 8. Winners
  • The author of the winning entry will be notified by email. In order to be declared a contest winner and be eligible for a prize, the entrant must have complied with, and remain in compliance with, these rules, and must sign and deliver to The Big Wild, CPAWS or MEC (within days of The Big Wild, CPAWS and MEC's request) a standard declaration and release form (which will include a declaration of the finalists' compliance with these rules, an acceptance of the prize as awarded, a publicity release, a liability release, and the correct answer to a skill-testing question) and any other documentation that The Big Wild, CPAWS and MEC may require.
  • The Big Wild, CPAWS and MEC may request valid proof of identity, residency, age and other relevant documentation, and The Big Wild, CPAWS and MEC may disqualify a finalist if The Big Wild, CPAWS and MEC determines (in its sole discretion) that the provided proof is not sufficient.
  • If the prize notification is returned as undeliverable, or if a selected winner does not comply with all of the above requirements within the above time frames, or does not otherwise comply with these rules, the winner will be disqualified and the contest judges will select a replacement winner.
  • The chances of winning will depend upon the number of entrants.
  • 9. Cancellation
  • If for any reason The Big Wild cannot run the contest as planned (including as a result of bugs, tampering, unauthorized intervention, fraud, technical failures, infection by computer virus or any other cause that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this contest) The Big Wild staff may cancel, modify, extend or suspend the contest. In that event, The Big Wild, CPAWS and MEC may award a prize at random from among the eligible entries received up to the time of the impairment, or award no prizes.
  • The Big Wild, CPAWS and MEC may also disqualify any individual who tampers with or in any way corrupts the entry process, or who attempts to undermine the legitimate operation of the contest by cheating, hacking, deception, or other unfair practices, or by attempting to annoy, abuse, threaten or harass any other entrants or The Big Wild, CPAWS and MEC representatives.
  • 10. License to The Big Wild, CPAWS and MEC
  • By entering a photo in the contest, you waive all rights you may have with respect to the photo, including all moral rights and rights of personality, publicity or privacy, and you grant to The Big Wild, CPAWS and MEC the unrestricted, royalty-free, perpetual, irrevocable, worldwide license (but not the obligation) to use, reproduce, communicate, modify and display the photo (in whole or in part) for any purpose without any fee or other form of compensation, and without further notification or permission, including without limitation the following purposes:
  • * reproducing, publishing, communicating and displaying some or all of the photo as part of the contest or otherwise;
  • * identifying you by name as the owner of the photo;
  • * judging the contest;
  • * displaying the winning entries in the contest; and
  • * for The Big Wild, CPAWS and MEC's advertising purposes, including to advertise the contest, future contests, and The Big Wild, CPAWS and MEC's products and services.
  • 11. Modifications
  • You grant to The Big Wild, CPAWS and MEC the unlimited right: (i) to edit or modify your photo in any manner, including by adding visual or aural effects or other elements; and (ii) to use, adopt and modify any or all portions of your photo in combination with other materials. When editing or modifying your photo, The Big Wild, CPAWS and MEC will use commercially reasonable efforts to maintain the original essence of the photo.
  • 12. Publicity
  • Except where otherwise prohibited by law, participation in the contest constitutes a winner's consent to The Big Wild, CPAWS and MEC's use of the winner's name, home town and province for promotional purposes without further notification, permission, payment or consideration.
  • 13. Disclaimers, Liability, and Indemnification
  • The Big Wild, CPAWS and MEC do not accept liability for any loss or damage of any stories, photos, or videos entered in the contest or for any other loss or damage resulting directly or indirectly from your participation in the contest.
  • The Big Wild, CPAWS and MEC are not responsible for: (1) incorrect or inaccurate transcription of entry information or late, lost, incomplete, misdirected entries, or entries received through impermissible or illegitimate channels; (2) technical failures of any kind, including without limitation the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any service; (4) unauthorized human intervention in any part of the entry process or the contest; (5) electronic or human error which may occur in the administration of the contest or the processing of entries; or (6) any injury or damage to persons or property, including without limitation your computer, which may be caused, directly or indirectly, in whole or in part, from your participation in the contest or from downloading any material from The Big Wild website or Facebook page.
  • The Big Wild, CPAWS and MEC will not be liable to you for any indirect, special, consequential, or punitive damages in connection with the contest or these rules.
  • By participating in this contest, you release and agree to indemnify and hold harmless The Big Wild, CPAWS and MEC and their employees, directors, officers, affiliates, agents, judges and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your participation in this contest or receipt or use of any prize.
  • By participating in this contest, you further agree to indemnify and hold harmless The Big Wild, CPAWS and MEC and their employees, directors, officers, members, affiliates, agents, judges and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions or losses of any kind (including actual legal fees and expenses) arising from or related to: (a) your failure to comply with any of these rules; (b) any misrepresentation you make under these rules or otherwise to The Big Wild, CPAWS and MEC; or (c) your participation in the contest.
  • 14. Personal Information
  • You consent to The Big Wild, CPAWS and MEC using and disclosing your personal information for the purposes of administering the contest; advertising the contest and any future contests and any of The Big Wild, CPAWS and MEC's products and services; and for the other purposes described in these rules. If The Big Wild, CPAWS or MEC uses some or all of your photo for advertising purposes, The Big Wild, CPAWS and MEC will only disclose your first name in that advertising unless you consent to The Big Wild, CPAWS and MEC also disclosing your last name.
  • 15. Law
  • The Rules will be governed by and construed in accordance with the laws of the Province of British Columbia, Canada and the federal laws of Canada applicable in British Columbia.
  • 16. Disputes
  • All disputes, claims and causes of action arising out of or connected with the contest, prizes or these rules will be resolved individually, without resort to any form of class action, and exclusively by the appropriate court of the Province of British Columbia, Canada.
  • 17. Quebec Residents
  • In Canada, with respect to Quebec residents, any litigation respecting the conduct or organisation of a publicity contest may be submitted to the Regie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.
  • 18. Language
  • The parties have expressly requested that this Agreement and any related document be prepared in the English language. Les parties aux presentes ont expressement demande - ce que cette convention et les documents qui s'y rapportent soient rediges en anglais.
